Terms of Service

These Terms of Service (“Terms”) govern your use of audiencepartner.com (the “Site”) and the application process described on it. The Site is operated by Zellerhaus, LLC, an Arizona limited liability company (“Audience Partner,” “we,” “us”). By using the Site or submitting an application, you agree to these Terms. If you don't agree, don't use the Site.
1. What the Site is
The Site describes a joint-venture program in which we may build and launch a product with a creator who has a qualifying audience, on a revenue-share basis. The Site is informational and lets you apply. Nothing on the Site is an offer to enter into a joint venture, a guarantee of acceptance, or a promise of any revenue, outcome, or timeline. Any figures shown, including the audience math calculator and the worked example, are illustrative models based on stated assumptions, not forecasts or representations about your results.
2. Applications
- You must be at least 18 and able to enter binding agreements.
- You represent that the information you submit, including audience size, engagement, and past launch results, is accurate and that you have the right to share it. We verify audience claims against public platform data and third-party sources before any interview.
- Submitting an application does not create a partnership, joint venture, agency, employment, or fiduciary relationship. A relationship arises only under a separately signed memorandum of understanding or joint-venture agreement, whose terms control.
- We may accept or decline any application at our sole discretion and are not obligated to explain a decision, though we try to.
- Don't submit applications on behalf of someone else without their authorization, and don't submit automated or bulk applications.
3. Confidentiality of what you share
We treat application content as confidential and use it only to evaluate you and, if accepted, to work with you. We don't publish or share your application content outside Audience Partner and its service providers except as described in our Privacy Policy. Ideas you describe in an application remain yours. We may already be working on, or later independently develop, similar ideas; submitting an application doesn't restrict us from doing so, and any exclusivity is granted only in a signed agreement.
4. Intellectual property
The Site, its design, copy, code, and the audience math model are owned by Zellerhaus, LLC and protected by copyright and other laws. You may view the Site for personal, non-commercial evaluation. You may not copy, scrape, reproduce, or create derivative works from the Site without written permission. “Audience Partner” and the associated marks are ours.
5. Acceptable use
Don't interfere with the Site, probe or test its security, submit malicious content, misrepresent your identity, or use the Site for any unlawful purpose. We may block access for violations.
6. Third-party links and services
The Site links to third-party sites, including zellerhaus.com. Those sites have their own terms and we aren't responsible for them. Scheduling, payment, and other services used after acceptance are governed by those providers' terms and by the agreement we sign with you.
7. Disclaimers
THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DON'T WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY MODEL, ESTIMATE, OR FIGURE ON THE SITE WILL MATCH REAL RESULTS.
8. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, ZELLERHAUS, LLC AND ITS MEMBERS, MANAGERS, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SITE OR THE APPLICATION PROCESS. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS. SOME JURISDICTIONS DON'T ALLOW THESE LIMITS, SO THEY MAY NOT APPLY TO YOU.
9. Indemnity
You agree to indemnify and hold us harmless from claims, losses, and expenses, including reasonable attorneys' fees, arising from information you submit that is inaccurate or that you had no right to share, or from your violation of these Terms.
10. Governing law and disputes
These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law rules. Any dispute relating to the Site or these Terms will be brought exclusively in the state or federal courts located in Maricopa County, Arizona, and you consent to their jurisdiction. Before filing, you agree to contact us at hello@audiencepartner.com and attempt in good faith to resolve the dispute for 30 days.
11. Changes
We may update these Terms. The effective date above changes when we do. Continued use of the Site after a change means you accept it. Material changes to how we handle applications will be noted on this page.
